Deregistering a company (form 6010) & deregistration invoices
How to deregister a company in Waive:
If you would like to deregister a company, simply go to the company profile, and press on the company name to reveal the dropdown menu and select 'deregister company':
Please note that ASIC will not approve the deregistration form if the company has an outstanding ASIC balance pertaining to previous years.
Deregistration invoices:
ASIC don't issue the deregistration invoice immediately after a form 6010 is lodged and approved, although the debt is created immediately.
ASIC invoices are issued on a 14 day cycle, and the cycle varies from company to company, depending on when the last ASIC invoice was issued.
The invoice is created on the next occurrence of the company's cycle.
Once the deregistration is approved and the payment is processed, ASIC publishes a notice about the proposed deregistration in the ASIC Gazette.
Two months after the Gazette notice is published, ASIC deregisters the company.
For more information regarding the deregistration process with ASIC, please refer to this ASIC link.
If you are wanting to avoid the company having to pay their Annual Review Fee then please note that:
You would need to submit the 6010 deregistration form at least 2 weeks before the annual review invoice is due, for the annual review to not be payable.
Note that the company BPAY details never change, they will always be the same - you can see the company's BPAY details via any ASIC invoice ever issued to the company, or you can check here via the ASIC website by entering the ACN.
Things to consider when deregistering a company:
If the 6010 form is signed and approved by ASIC, but ASIC do not receive the $49 deregistration fee within a month of being issued - ASIC will reset the deregistration status of the company and you will need to submit another 6010 form. The deregistration process is not finalised until the $49 invoice is received by ASIC.
As an agent you do not have to wait for the deregistration invoice to be issued in order to pay ASIC. But by paying ASIC the $49 before the invoice is issued, means that ASIC will NOT issue the invoice.
PLEASE NOTE: If the $49 is not paid within 28 days of the 6010 form being approved, ASIC will cancel the deregistration process and keep the money (if paid after the 28 days) and you have to lodge another 6010 form and pay an additional $49 to finalise the deregistration process.
